dc.description.abstractUKR: Стаття присвячена комплексному дослідженню трансформації правового регулювання відносин інтелектуальної власності (ІР-відносин) в умовах соціального та цифрового спрямування сучасної економіки. Актуальність теми зумовлена швидкою цифровізацією господарських процесів, переходом до соціально орієнтованої моделі розвитку та необхідністю забезпечення балансу між стимулюванням інновацій і публічними інтересами суспільства. У роботі проаналізовано теоретичні засади соціальної функції права інтелектуальної власності, нові об’єкти ІР у цифровому середовищі (генерований АІ-контент, великі дані, алгоритми, віртуальні активи), а також особливості адаптації традиційних інститутів авторського, патентного права та засобів індивідуалізації до реалій цифрової економіки. Здійснено порівняльноправовий аналіз регулювання ІР у ЄС, США та країнах Азії. Особливу увагу приділено сучасному стану та проблемам правового регулювання ІР-відносин в Україні в умовах європейської інтеграції та повоєнного відновлення. Доведено, що ефективне правове регулювання ІР у сучасних умовах вимагає розвитку гібридних моделей, посилення соціальної функції права, запровадження нових інститутів (соціально-цифрові ліцензії, спеціальний АІ-режим) та подальшої цифровізації системи управління правами. Запропоновано стратегічні напрями вдосконалення законодавства та державної політики у ІР-сфері до 2030 року.uk_UA
dc.description.abstractENG: This article is devoted to a comprehensive study of the transformation of the legal regulation of intellectual property (IP) relations in the context of the social and digital orientation of the modern economy. The relevance of this topic stems from the rapid digitization of economic processes, the transition to a socially oriented development model, and the need to strike a balance between fostering innovation and safeguarding the public interest. This paper analyzes the theoretical foundations of the social function of intellectual property law, new IP objects in the digital environment (AI-generated content, big data, algorithms, virtual assets), as well as the specifics of adapting traditional institutions of copyright, patent law, and means of individualization to the realities of the digital economy. A comparative legal analysis of intellectual property regulation in the EU, the United States, and Asian countries has been conducted. Particular attention is paid to the current state and challenges of legal regulation of intellectual property relations in Ukraine in the context of European integration and post-war reconstruction. It is demonstrated that effective legal regulation of IP in the current environment requires the development of hybrid models, strengthening the social function of law, introducing new institutions (socio-digital licenses, a special AI regime), and further digitization of the rights management system. Strategic directions for improving legislation and state policy in the IP sphere through 2030 are proposed.en
