BIM-сімейства, як об’єкти права інтелектуальної власності: технології шифрування та захисту

UKR: Стаття присвячена проблемі технології шифрування та захисту BIM-сімейств, як об’єктів права інтелектуальної власності. Сьогоденна епоха діджиталізації розширила роль BIM-технологій, які стали не просто допоміжним інструментом для спрощення моделювання, але засобом передачі знань, виробничих норм та робочої практики у будівництві. У той же час виготовлення великих масштабів сімейств Revit, параметричних компонентів та бібліотеки елементів актуалізувало проблему захисту права інтелектуальної власності на ці об’єкти. Дослідження правників та практиків з BIM технологій останніх років доводять, що BIM-об’єкти підпорядковуються усім нормам права інтелектуальної власності та потребують свого захисту цим правом.

ENG: The article is devoted to the issue of encryption technology and the protection of BIM families as objects of intellectual property rights. The current era of digitalization has expanded the role of BIM technologies, which have become not merely an auxiliary tool for simplifying modeling, but also a means of transferring knowledge, production standards, and working practices in construction. At the same time, the large-scale creation of Revit families, parametric components, and element libraries has brought to the forefront the problem of protecting intellectual property rights in these objects. Studies by legal scholars and BIM technology practitioners in recent years demonstrate that BIM objects are subject to all norms of intellectual property law and require protection under this legal framework.
