Особливості договірних відносин у сфері трансферу технологій: аналіз наукових підходів та законодавчого регулювання

UKR: Трансфер технологій – це комплекс процесів, що забезпечує передачу науково-технічних досягнень від розробників до виробничих і комерційних структур, сприяючи інноваційному розвитку економіки. Ефективність цього процесу залежить від правильно обраної моделі співпраці, правового оформлення взаємовідносин між сторонами та відповідності укладених договорів чинному законодавству. У даній статті здійснено аналіз наукових підходів до класифікації договорів у сфері трансферу технологій, встановлено їх особливості з посиланням на ключові джерела та враховано положення Закону України “Про державне регулювання діяльності у сфері трансферу технологій».

ENG: Technology transfer is a complex of processes that ensures the transfer of scientific and technical achievements from developers to production and commercial structures, contributing to the innovative development of the economy. The effectiveness of this process depends on the correctly chosen model of cooperation, the legal formalization of the relationship between the parties and the compliance of concluded agreements with the current legislation. This article analyzes scientific approaches to the classification of contracts in the field of technology transfer, establishes their features with reference to key sources and takes into account the provisions of the Law of Ukraine "On State Regulation of Activities in the Field of Technology Transfer".
